Undesirable Over Reach

The Supreme Court over reach is really a cause for worry.

The duty of the SC, or for that matter any court, is only to ensure that laws passed by the Legislature are implemented properly, and to check whether there are any deviations. If there are deviations, they can correct it, punish the errant and give relief to the person affected.

The SC has no right whatsoever in asking Delhi Metro to check whether they can run a train service every 90 seconds, against the current 150 seconds. Don't tell me SC judges have better Operational experience than the Railway people as to how to manage the rolling stock!! This is totally uncalled for.

We also see SC appointing Special Investigating Teams (SIT) to investigate certain crimes. This is again not its job. Admitted the Police -Politician nexus is very tardy in taking many cases to logical conclusion, but SC is not CBI, nor it should be. If SC feels the Police or Politician is deliberately hampering the case, then it can give exemplary punishment to those guilty. Let them just jail one SP or DGP or MLA for obstruction of justice, and others will not dare go slow or sabotage cases.

The self same SC which preaches everyone else how to do their work, takes an ostrich like stance when it comes to doing its work properly. Chief Justices come and go, but we have not seen any concrete action being taken to make the judicial system more transparent, efficient, and reduce the time delay in giving a verdict. When SC stops the trial of a case to give a special hearing whether Teesta Setalvad should be given anticipatory bail or not, then that is the pits.

Out of a false sense of respect to the judiciary, people keep quiet. But the Courts are shooting themselves, if they continue their brazen over reach.
